Conditions of participation

1. Contract and liability of the organizer

1.1 The organizer is guided in its activities by the Estonian Tourism Act, the Law of Obligations Act and other legal acts of the Republic of Estonia.

1.2 The organizer is responsible for ensuring that the hike matches its description.

1.3 The organizer is not liable for damage caused by force majeure (natural disasters, war, political incidents, strikes, weather conditions that differ from the yearly average, etc.).

1.4 The participation fee covers the services that are included in the description and in the correspondence between the parties. If the participant chooses not to use a service that is included in the price, the participant is not entitled to a refund for it.

1.5 The organizer has the right to increase (and, accordingly, the obligation to reduce) the price if this is caused by significant changes that the organizer could not foresee and that do not directly depend on the organizer, such as changes in exchange rates, changes in taxes in Estonia or the destination country, changes in transport or accommodation prices, etc.

1.6 The participant is personally responsible for obtaining travel insurance suitable for the activity. If the participant falls ill, has an accident or becomes a victim of crime, the organizer will assist the participant in every way, but the participant pays the related additional costs, etc. If insurance is not purchased, the participant bears all possible additional material costs that may arise in connection with an accident, illness, crime, etc. If insurance is mandatory for participation, this is stated in the description of the activity.

1.7 The organizer has the right to interrupt the performance or change the plans and involve other group members in providing assistance if a group member has an accident that requires the help of other group members and local emergency services cannot be relied on.

2. Registration for the hike, conclusion of the contract and payment

2.1 Registration for the hike is done by filling in the registration form on the website.

2.2 The contract between the participant and the organizer becomes binding on both parties at the moment the participant has paid for the booked hike, unless the description states a different payment schedule or one has been agreed with the organizer.

2.3 If the number of participants required by the description has not been reached, the organizer has the right to postpone or cancel the hike by giving notice at least 7 days before the hike. In this case the advance payment is refunded in full.

3. Cancellation terms

Hikes abroad

3.1 If the participant withdraws from the hike at their own request, the organizer refunds the participation fee received from the participant according to the following:

3.1.1 if the hike is cancelled more than 35 days before the start of the hike, the 20% advance payment that was paid remains with the organizer to cover organizational costs;

3.1.2 if the hike is cancelled 35 to 7 days before the start of the trip, the 40% advance payment that was paid remains with the organizer to cover organizational costs;

3.1.3 if the hike is cancelled less than 7 days before the start of the hike, the participation fee is not refunded.

3.2 If the participant does not show up, is prevented from taking part in the hike by their state of health, lacks the necessary documents, etc., the participation fee is refunded according to the terms of clause 3.1.

3.3 If it becomes clear at the meeting point of the hike that the participant does not have the hiking equipment required by the organizer, the group leader has the right not to allow the participant to join the hike, and the group will not wait for the participant. In this case the participation fees are not refunded and the additional costs incurred are borne by the participant.

Hikes within Estonia

3.4 For hikes of a couple of hours and one-day hikes, the participation fee is not refunded if the hike is cancelled less than 3 days before the start of the hike.

3.5 For multi-day hikes, the participation fee is not refunded if the hike is cancelled less than 5 days before the start of the hike.

4. Duties and responsibilities of the participant

4.1 The participant is obliged to follow the relevant instructions of the group leader.

4.2 The participant is forbidden to deviate from the planned route without the consent and knowledge of the group leader, or to do other things that endanger themselves and/or other group members. The participant is liable for damage that their intentional or negligent actions cause to the organizer, fellow travelers or third parties.

4.3 The participant is responsible for the validity and care of their personal travel documents.

4.4 The participant is obliged to make themselves aware of the dangers that come with the political and economic situation of the areas traversed on the hike (including adjacent areas), and takes full responsibility for this and, where necessary, pays the related additional costs.

4.5 Additional costs arising from interrupting or ending the activity early at the participant's request are paid by the participant.

4.6 In an emergency where the help of local emergency services is not available, the participant is obliged to help other group members in trouble within the limits of their abilities and skills, and to be ready to interrupt their own performance or change plans.

4.7 The participant is obliged to make themselves aware of the risks arising from the nature of the activity. By registering, the participant confirms that they are aware of these risks and ready to bear them (including injuries, trauma, permanent disability or death that may result from participation).

4.8 The participant is fully responsible for their minor children on hikes where children are permitted and have been brought along.

5. Compensation for damage

5.1 Claims and demands for compensation for damage must be submitted to the organizer in writing during the hike or no later than 5 working days after the end of the hike.
