Land rental terms for renters
1. General provisions
1.1. These terms apply to the temporary rental of a land plot for camping offered through the Hiking BaltNorth booking environment.
1.2. The booking environment is managed by Pilved OÜ, registry code 14382881, address Tallinna mnt 52, Võru linn, Võru maakond 65605, e-mail [email protected], which operates under the Hiking BaltNorth brand (hereinafter the Intermediary).
1.3. The lessor of the land plot is the landowner named on the specific booking page or the lawful user of the land plot (hereinafter the Landowner).
1.4. The person who has made the booking is hereinafter the Renter.
2. Content of the service and roles of the parties
2.1. This is the temporary rental of a land plot or a delimited part of it for camping. The Renter uses their own tent, sleeping gear and other necessary equipment.
2.2. The offer consists only of the use of a land area for camping with the Renter's own equipment; it does not include a ready-made sleeping place. On-site facilities are described on the booking page. When booking, the Renter may choose an extra rental (e.g. a bicycle, boat or sauna) that the Landowner lets the Renter use; the Renter uses it themselves and takes good care of it. The fees for the site and extra rentals are collected in the name and on behalf of the Landowner.
2.3. The Intermediary publishes the information submitted by the Landowner, receives the booking and the payment, and forwards the information related to the booking to the Landowner.
2.4. The land plot rental agreement is concluded between the Landowner and the Renter. The Intermediary is not the lessor, does not take the rented area into its possession and does not organise camping on site.
2.5. The name and contact details of the Landowner are published on the booking page when the booking is made and are sent in the booking confirmation.
2.6. If Pilved OÜ (Hiking BaltNorth) is named as the Landowner on the booking page, Pilved OÜ is also the lessor and a party to the rental agreement. In that case no service fee is added.
3. Conclusion and entry into force of the rental agreement
3.1. The rental agreement between the Landowner and the Renter is deemed concluded and enters into force when the Renter has submitted a booking in the Hiking BaltNorth booking environment managed by Pilved OÜ, accepted the rental terms and the usage rules of the specific rented area, and paid for the booking. No separate contract is signed. If the Landowner is not Pilved OÜ, Pilved OÜ acts on behalf of the Landowner as an intermediary of the booking and the payment and is not a party to the land plot rental agreement.
3.2. By submitting a booking, the Renter confirms that, before booking, they have read and accepted these rental terms, the description and location of the rented area, the rental period, the total price, the arrival and departure arrangements, the on-site facilities and restrictions, the usage rules and the cancellation and refund terms.
3.3. Special terms published for a specific rented area before the booking is submitted supplement these general terms. In the event of a conflict, the special terms of the specific booking prevail, taking into account mandatory legal provisions.
3.4. The Renter is responsible for the accuracy of the data submitted when booking. Once the payment has been received, a booking confirmation with an invoice is sent to the Renter's e-mail address. The booking can be viewed and managed in the Renter's account (My account → My bookings); an account is created automatically when booking if needed.
4. Use of the rented area
4.1. The Renter may use only the land plot named in the booking and only during the booked period.
4.2. The rented area may be used for camping and for other activities that are expressly permitted on the booking page.
4.3. The Renter must comply with the Landowner's usage rules, on-site signs, fire safety requirements, nature conservation restrictions and requirements arising from legislation.
4.4. Without the prior consent of the Landowner, the Renter may not transfer the use of the rented area to a third party, exceed the number of people, tents or vehicles stated in the booking, make a campfire or use open fire in a place where it is not permitted, fell or damage trees and other vegetation, build permanent structures, dig the soil, organise a public event or commercial activity, or enter areas that are not in the Renter's use under the booking. The Landowner's consent does not replace permits required by law or override valid restrictions.
4.5. The Renter must not disturb neighbours, other users of the area or animals.
4.6. Pets are allowed only if this is stated on the booking page. The animal must be under the owner's supervision and must not disturb other people or animals or damage property or nature.
4.7. When leaving, the Renter must leave the rented area in at least the same condition as on arrival, taking normal use into account. Waste must be taken along or placed in the designated place.
5. Arrival and departure
5.1. Arrival and departure times are published on the booking page. The exact address of the rented area, a map link, the Landowner's contact details and arrival instructions are sent to the Renter by e-mail after the payment has been received, and as a reminder one day before arrival.
5.2. The Renter must arrive and depart at the agreed time. Any delay or other significant change must be reported as soon as possible to the contact stated in the booking confirmation.
5.3. Driving and parking with a vehicle is allowed only in places permitted by the Landowner. The Renter is responsible for ensuring that the vehicle does not damage the soil, roads, plants or other property.
6. Price and payment
6.1. The rental price, any additional fees, the total price and the payment procedure are displayed before the booking is submitted.
6.2. The booking can be paid by bank link, card payment or by invoice (bank transfer).
6.3. When paying by bank link or card, the booking is confirmed immediately. When paying by invoice, the booking is confirmed when the payment has been received; the invoice must be paid by its due date. If the payment is not received by the due date, the booking may be cancelled and the dates released. The exact address and arrival information are sent after the payment has been received.
6.4. If the Landowner is not Pilved OÜ, the Intermediary receives the rental payment on behalf of and for the account of the Landowner and adds to the total price a service fee of 5 euros (VAT included) per booked night, regardless of the number of pitches. The rental price and the service fee are shown as separate lines on the invoice.
6.5. If the Landowner offers a non-refundable rate, the Renter can choose when booking between the standard price with free cancellation and a discounted price that is non-refundable (see clause 7.8).
7. Changing and cancelling a booking
7.1. The cancellation rule is set by the Landowner. It is shown on the booking page, at checkout and in the booking confirmation: free cancellation up to 1, 3, 7, 14 or 30 days before arrival (until 23:59) or a non-refundable booking.
7.2. Within the free cancellation period the Renter can cancel the booking in their account (My account → My bookings). The booking is cancelled immediately, the dates become available again and the rental price is refunded to the same payment method within a few business days; the service fee is not refunded. After the deadline or for a non-refundable booking, the Renter can send a cancellation request from their account or by e-mail to [email protected], stating the booking number and the name of the person who made the booking.
7.3. Refunds for a rental period left unused by the Renter are made in accordance with the terms of the specific booking and the applicable law.
7.4. Bad weather, a change in the Renter's plans or late arrival at the rented area does not automatically give a right to a refund. A refund depends on the cancellation terms of the specific booking and on the law.
7.5. If the Landowner is unable to make the booked area available, a suitable replacement or a change of the booking time is offered, where possible and with the Renter's consent. If the Renter does not agree to the replacement or change, the amount paid for the unused rental period is refunded. The Renter's other rights arising from law are preserved.
7.6. The Landowner, or the Intermediary acting on the Landowner's behalf, may cancel the booking or suspend the use of the rented area if use of the area is not possible due to fire risk, flooding, a storm, an access obstacle, an official restriction or another significant safety risk. The Renter will be notified as soon as possible. The refund is arranged in accordance with clause 7.5 and the law.
7.7. The rights of withdrawal and other rights of a consumer arising from law apply to the extent that they are mandatory for the relevant agreement. These terms do not limit rights from which, under the law, it is not permitted to derogate by agreement.
7.8. Refunds: if a booking at the standard price is cancelled within the free cancellation period, the rental price is refunded to the same payment method. If it is cancelled after the deadline, or if the Renter does not show up, the money is not refunded. If a booking at the non-refundable (discounted) price is cancelled, or the Renter does not show up, the money is not refunded. The service fee is not refunded in any case, except in the cases described in clauses 7.5 and 7.6.
8. Safety and the Renter's liability
8.1. Camping takes place in a natural environment. The Renter must take into account the weather, uneven ground, trees and branches, bodies of water, insects, ticks, wild animals and other circumstances typical of a natural environment.
8.2. The Renter assesses their own abilities, health, suitability of equipment and weather conditions, and chooses activities according to the actual conditions.
8.3. The Renter must ensure that the persons staying with them follow the usage rules of the rented area. Minors must be under the supervision of a responsible adult.
8.4. The Renter is responsible for the safekeeping of their own tent, vehicle, equipment and other personal property. Neither the Landowner nor the Intermediary takes the Renter's property into custody.
8.5. The Renter is liable, to the extent provided by law, for damage caused to the Landowner, the rented area, nature or a third party by the Renter's activity or breach of obligation.
8.6. A fire, accident, damage to property or other significant incident must be reported to the Landowner and the Intermediary without delay. In an emergency, call 112.
9. The Landowner's liability
9.1. The Landowner is responsible for having the right to make the land plot named in the booking available to the Renter.
9.2. The Landowner is responsible for the accuracy of the information they have confirmed about the description of the rented area, access, usage rules, on-site facilities and hazards known to them.
9.3. The Landowner must keep the rented area reasonably accessible at the agreed time and suitable for the use described on the booking page.
9.4. The Landowner's liability for damage is determined on the basis of their obligations and the law. Damage resulting from the Renter's activity, a breach of the usage rules, unsuitable equipment, weather or ordinary risks of the natural environment does not automatically fall within the Landowner's liability.
9.5. These terms do not exclude or limit the Landowner's liability where the exclusion or limitation of liability is not permitted by law.
10. The Intermediary's liability
10.1. The Intermediary is responsible for the booking environment, the receipt of bookings and the intermediation of payments within the scope of its actual role.
10.2. The Intermediary is not liable in place of the Landowner for the condition of the rented area, on-site access or the Landowner's actions. The Intermediary is liable for the breach of its own obligations to the extent provided by law.
10.3. The Intermediary does not provide a property custody service and does not guarantee the safety of the Renter's property. Loss of or damage to property, and damage resulting from the natural environment, the weather or the actions of the Renter or a third party, does not automatically fall within the Intermediary's liability.
11. Defects and complaints
11.1. If the rented area does not match the description on the booking page or cannot be used, the Renter must notify the Landowner and the Intermediary as soon as possible, preferably before leaving the area.
11.2. Where possible, the defect should be documented with photographs or other relevant information, and the Landowner should be given an opportunity to resolve the problem within a reasonable time.
11.3. A complaint can be submitted to the e-mail address [email protected]. The complaint must state the Renter's name, the booking number, a description of the incident and the desired solution.
11.4. The Intermediary forwards to the Landowner any inquiry concerning the Landowner or the rented area and helps the parties exchange the necessary information.
11.5. If the Renter is a consumer and the other party to the agreement acts as a business, the Renter has the right to use the out-of-court dispute resolution options provided by law, including to contact the Consumer Disputes Committee (Tarbijavaidluste komisjon), if the conditions for its competence are met.
12. Processing of personal data
12.1. The Renter's personal and contact data are used to administer the booking, the payment, the rental period and customer communication, and to perform obligations arising from law.
12.2. The data necessary for performing the booking are forwarded to the Landowner to the extent necessary for the performance of the rental agreement.
12.3. The detailed procedure for the processing of personal data is published in the Hiking BaltNorth privacy policy.
13. Final provisions
13.1. The rental agreement is governed by the law of the Republic of Estonia, without limiting the protection of the consumer arising from mandatory legal provisions.
13.2. Disagreements shall first be resolved by negotiations between the Renter, the Landowner and, where necessary, the Intermediary.
13.3. If a disagreement cannot be resolved by agreement, the dispute shall be resolved in accordance with the procedure provided by law. A Renter who is a consumer retains the rights arising from their place of residence and from mandatory legal provisions.
13.4. The Renter can save or print the terms before submitting the booking.
13.5. A booking is governed by the rental terms that were available to the Renter and that the Renter accepted at the time of submitting the booking.
